The consumer here is putting money in the driver’s pocket. The company is just providing a guarantee as to the minimum the driver will get out of the deal.
In a lot of states, tipped employees are paid less than minimum wage, while the company has to make up the difference if the employee doesn’t get tips sufficient to make minimum wage, so this isn’t actually a new concept.
