But I think there are some... perhaps not “legitimate” but comfort concerns with having no idea about this person what will be in your home potentially? I spend a lot of time at my boyfriend’s place and was considering renting out my one-bedroom on occasion, but I was pretty committed to only renting it out to women.

I would be willing to agree with that. But, without actually look at the data, I would also bet that hotels are still pretty damn discriminatory when it comes to booking in person or in situations where they also have a clients photo or name. It would have to be system design, I think, and would generally require reducing the social networking aspects of it so that real names and photos including people were optional or deemphasized or only available after approving a booking. And, yes, that might destroy what makes AirBNB good.

It’s a little different, because they’re arguably providing hotel services, which are covered by the Civil Rights Act of 1964.

It still matters. AirBNB is set up in a way that allows property owners to racially discriminate. There are ways it could prevent that, and to the extent it’s set up to provide hotel services, I think there’s at least an argument it could be held responsible if it doesn’t.
