Gorsuch is a rule’s lawyer of the highest order. That’s what he was doing here.
To get to “Gay”, it would be “A man who has sex with men.” If you change that to “A woman who has sex with men” and get a different outcome, you’ve had to define “Sex”, which is protected in Title VII, and thus the ENTIRE THING is protected.
