Serious question on this one. If the product had an open recall from 4 years ago that she hadn’t acted on, does the family still have grounds in their suit? I mean technically the company had already put out a warning saying “hey, we know these are defective, stop using them”

Being Lexus, my guess would be they were more concerned with long term reliability than the numbers game. While I am far from any type of engineer, I would guess this engine is VERY under stressed at 470 HP.
