You first have to prove his intention to kill versus injure. There is actually a difference between manslaughter and murder.

Your unprofessional opinion is noted, and disregarded by nearly all people who have actually spent 5 actual minutes researching the matter. The grand jury would also tend to agree with me, hence no criminal charges were ever brought, even with expert testimony and no lack of witnesses.
