Good point about the Fifth Amendment. Honestly, more of my defendants testify that many other lawyers’. Whether that’s right or wrong, I don’t know, but that’s just how it works out. I can totally commiserate with a person absolutely wanting to testify rather than have horrible things said about them go unanswered.

But the current burden is basically the same: the government must prove a lack of consent (beyond a reasonable doubt). They, too, must prove a negative.

I think that what should really happen is that, when the jury is instructed with the law, there should be a freestanding jury instruction or two about how victims often go back to their abuser, wait to report, may not have physical injuries since they didn’t get a rape kit
