They do - here's a little bit more information on how it all works, and the history of it.
It used to be like that, but we do now have a Crown Prosecution Service which does the majority of trials. For certain specialist things they will still use a specialist private barrister however, and there is always the possibility of a private prosecution.

It's a comparably low downforce circuit compared to somewhere like COTA. If Nissan are going all out for Le Mans then designing the floor to create the exact amount of downforce required to run at Le Mans without a wing is a pretty good way of going about it.
