Consumer law trumps TOS. In the UK, EU and Australia their EULA/TOS is utterly meaningless. In the US you might have to go to your AG, as Streetroller did, but they don’t get to take your money and deliver nothing in return just because they bake it into an unethical TOS.

That’s not how Kickstarter works. Kickstarter’s own terms say this, and US, EU and Australian law do not support your belief.

They run regular ‘sales’, they charge VAT (Sales Tax) on those sales.
