As some others have noted, the actual FIA ruling said that the fuel tank exceeded 96 liters. They simply stopped measuring once it exceeded 96.1 liters as it was clear that they had broken the rule, and when the punishment is disqualification, it doesn’t really matter how much you broke the rule by.
