I think you’re missing the important part of that clause. It’s not that Pence gets to pick. It’s that the House gets to confirm. If they’re impeaching Pence, they’re not giving him a new VP no matter how long the GOP Senate would delay. In other words, it would not affect the line of succession.

Doesn’t that mean that the office will just stay open, if the Democrats pull the same stunt the Republicans pulled with Merrick garland?
