With the right Lawyer there is absolutely a case there. they have all the signs in the world, but still get a crash at LEAST once a month. Somethings obviously not working. You'd be surprised how often the law will change for stupid people.

Private collectors lend their pieces to museums a lot of times, and they like the idea of no one being able to view the work anywhere else. So there's multiple reasons beyond "no flash". Its why you cant just go online and view every single piece of artwork that Picasso has ever done.
