ISPs have to give information of suspected copyright violators under the Safe Harbor provision of DMCA. Basically, they are given a “safe harbor” from being prosecuted themselves for enabling the copyright infringements, as long as they willingly turn over the identities of people who do.
Whether the downloaders happened upon the content by “accident of randmoness” is immaterial. The content was put up there by the owners of the content.
It’s not accidental. They deliberately put their own content up.
They posted the content they had rights to as bait for illegal downloaders. They didn’t care about profiting from actually openly marketing their content.
