The reason this is a story is because Ally is a prestigious player. So you set that up first, and then the rest of the story flows in a chronological fashion. It’s a perfectly legitimate and effective way of writing a news story.
For the good of the order: The court didn’t decide anything. James Romine agreed to voluntarily dismiss the charges with prejudice. Kotaku’s apparently fallen in love with “thrown out of court,” which is factually inaccurate.

Some of the things on your list are coming in the future (VC, streaming services, video capture). Other things would make the price skyrocket (disc drive, larger storage, more power). A few things are useless to include because virtually no one would use them (web browser, physical media playback).

The WiiU eShop wouldn’t permit a purchase unless you had enough space to download the game. I imagine the Switch eShop will be the same.
And it’s a stupid point. He’s basically saying that because he believes Nintendo plays fast and loose with fair use (which is wrong, because he doesn’t understand how fair use works procedurally), he can do the same and pirate their games. It’s the type of argument a 6-year-old makes.
It’s a shame this doesn’t get Content IDed anymore, because he won’t play it.
My understanding is that even if he won, it wouldn’t be worth it because Romine / Digital Homicide doesn’t have any money.

I’m glad Jim won his case, but this headline is factually incorrect. The court didn’t “throw out” Digital Homicide’s case. According to Jim’s own statement, James Romine agreed to dismiss the charges. A stipulation of dismissal is one that comes from the parties, which is why the court didn’t sign the document.
