It’s a frivolous lawsuit because the they knew that there was little or no chance of the lawsuit succeeding in court. That is the very definition of a frivolous lawsuit. Just because they were the first to hit it big doesn’t mean they owned an entire gaming genre.

Specially considering that the majority of the time, these people are working on games and only address huge crowd once, maybe twice a year.
