I think Nick was just trying to find out in a pretty obvious way if there was anything going on between Kalinda and Cary. Since being gay pretty much rules that out, the first step was to find out if Cary was gay. Poorly executed as it was, it was not flirting.

So I guess it's not a problem that a judge perjured himself? He lied on the stand about being biased and even Amanda Peet's ASA character knew about it. How else could she know that the judge meant the cheating forum, and not the Latin law term when he said "arias res" (or something like that) to Will in the bar?…
