I think the context for the Federal plaintiffs is a little different, because the holdouts rejected the settlement when they knew the case was literally hopeless…

It’s a very well-established rule. Plaintiffs who reject reasonable settlement offers and opt for trial are on the hook for the defendant’s legal fees if they lose or can’t get a judgment larger than the settlement offer.
I get that this woman is grieving but a Federal Court is not the place to do that.
There’s a lot of misinformation here about this rule in the comments, so I’ll post it.
FEDERAL RULE OF CIVIL PROCEDURE 68(d):
If the plaintiff rejects a reasonable settlement offer, goes to trial, and either loses or gets a judgment smaller than the settlement offer (in other words, fucking wastes everybody’s time), they’re on the hook for the defendant’s legal fees.
Well, I wouldn’t be THAT confident.
