It’s a good point, although from my experience as a fan and player, it feels like the majority of penalties result from incidental and not intentional contact.

I agree that that would be a bummer. Like when an NBA player has a wide open layup and a foul puts him on the line and he goes from 2 sure points to an expected value of 1.5 points (if he shoots 75%).
