It isn’t semantically a sale, though. If it were a sale, the money would be tied to paying FOR the fetus tissue itself. If no money is allocated to paying for fetal tissue directly, then that fetal tissue has not been sold. That’s the semantic battle that’s ongoing here.

You’re leaving out the intent, which is important to this argument. The law states you’re entitle to receive a “reasonable payment” in exchange for fetal tissue. This blankets it under a quasi not-for-profit exchange in order to recuperate some of the costs for storage, transportation, etc.
