I’d argue (in this specific case) it’s essentially the same as taking the French Version of Harry Potter and professionally translating it back into English, as they (according to claims from the original team) used a decompiler to generate their source code from the executable.

According to google search, the original team claimed they used a decompiler on the executable. That’s about as “has roots in the original code” as you can get.

Read again. You don’t need a (legal) copy of said game. You need a copy of the original assets.  Models, textures, audio files, etc.  Those can easily be put up in a zipfile somewhere for anybody and his brother to download. All the copy protection is in the engine/medium, which their changes neatly avoid.

Considering, according to quick google search, the original team says they used a decompiler to generate the source code from the shipped executable. (and debug symbols, which apparently shipped with the PS2/android versions for some reason.)
