Protected class can totally be done. DC protects weight too, although they use the catchall “personal appearance.” It was phrased that way so it could also cover other appearance discrimination issues like natural hairstyles.

DC has made size discrimination illegal by making physical appearance a protected class, just like race or gender, so it can be done. Enforcement can be a problem because people don’t know their appearance is protected or don’t have the resources to legally pursue it.
