From what I remember from an earlier article here about the case, the victim is profoundly disabled; therefore she cannot legally consent.

I thought an earlier discussion of this case included a statement from the victim’s family that she is not in a vegetative state (nor unconscious) but was suffering from significant developmental/intellectual delays.

There must be more $$$ left in MJ’s estate than I thought.
