Leaving a sandbag off the track isn’t gross negligence. It’s not smart, but a reasonable person would assume that running off the track on a motorcycle at any track is going to cause injury, sandbag or not. A hazard on the track is 100% different than off.
What about his own negligence for not attending the drivers meeting? How about for driving too fast for the corner?
