Driving can’t be done involuntarily, the charge of driving while intoxicated doesn’t require intent for you to be in that state, it requires intent to operate a vehicle in that state. Plenty of people get dui’s for drug interactions and even unexpected results of over the counter medications, and it does stick.

It also may have just been an ambiguous statement, and what they meant was that the evidence would not support a criminal complaint on the DUI charge.
