What I mean is that the first thing that has to be proven is that her work is close enough to the others’ works to find that there’s a prima facie case of plagiarism (the similarities are such that it seems like she could have plagiarized). If there aren’t significant similarities, the suit would be thrown out.

But that doesn’t speak to plagiarism. That’s a separate issue - he has to show that the work was originally his, the spyware is a secondary issue because it would be how she accessed his work.
It seems like she installed spy-ware on her own computer, which she thought he was using to cheat on her. That actually doesn’t seem that bad.
But I think he’s using that to discredit her work, bc she really did spy on him and he knew it and he (or a lawyer) realized all the things they can do to discredit her. I have no horse in this race but I can see how he could work that story out and make it believable, I don’t trust dick anymore TBH.
I’m rooting for these crazy kids to work it out and find an amicable resolution - like him giving her all his money after a judge slaps him with a restraining order and sentences him to chemical castration.
