I understand - though 'not qualifying for tax breaks' is (in effect) a taxing. The point-behind-my-point is that the language is written (in this iteration at least) singling out a specific genre of a medium. It's problematic on many levels and could be combated from several directions:

I'm no big city lawyer, but since the opinions on the 2011 ruling specifically state that 1st Amendment Rights apply to video games, whether they be "violent" or not, that portion of the tax code wouldn't stand for long?
