i think you’re on the right track, but it’s more like, you can sue anybody for anything (and there are stupid attorneys out there that will still the plaintiffs on as a client), but collecting is still part of the fun, assuming you win your case...
unless, the ‘defendant’ has taken steps to isolate/encumber their ‘assets’ a fair amount of time ahead of causing the damage..
you are right in the sense that you don’t sue the insurance company, per se.. you sue the offender or their estate and by legal contract of insurance policy, any insurance company steps into the ‘offender’s’ shoes and defends them and pays any adjudicated/settled claims, subject to the policy limits. that does not…
people are clueless.. personal injury attorneys name everyone in a lawsuit and let the now - defendants convince a judge to let them wriggle out...
