I know the truth came out during the trial but wasn’t there a way to call an expert in since it was the defense’s questions which brought this to light?

Similarly, if someone is guilty of attempted murder, and the alleged victim is later self-destructive or attempts or later commits suicide, the alleged perpetrator should be declared innocent as they were only doing what the alleged victim wanted.
The crown just seemed to cave in after it was revealed their witnesses lied as though no expert could explain it.
If the prosecutor has immunized you, then you can’t take the Fifth. If you refuse to testify you can be jailed for contempt.
in Ghomeshi’s case he’s more or less said as much himself, just twisted the context via “consent” argument
This thread is hilarious. I always wondered if there really were the type of deluded people who truly believed that such basic rights like the presumption of innocence and freedom of speech/expression only existed in the United States. Like there isn’t a single other free country in the world (you know, like Canada?…
Unless you are a survivor, shut up about what is good or bad for us.
This is what really bothers me here. It’s pretty well-established that Jian has attacked women.
Except the crown didn’t “cover it up” - especially if they were unaware of it, as would seem to be the case.
Now I understand why Ghomeshi asked for a bench trial. A “the victims perjured themselves” defense would be hard to sell to a jury.
I wonder why you had to post this as a “top level” comment. Oh wait. Because literally *nobody* in these comment threads have said that having sex with, being nice to, or having any kind of civilized contact with your rapist makes him not a rapist. That strawman sure had it coming though.
It is possible that perjury can be indicative of trauma.
No we don’t. We had the advantage of writing our Charter of Rights and freedoms from scratch in the 1980s, so we included all those rights the “amendments” granted our American cousins in the first draft.
Better question: Why not?
You forgot about section 11(c).
I mean, if I was accused of murdering my wife, and I say no, it was an accidental death, and talk about how I am in grief, but then the prosecution produces records showing that I took my ex girlfriend to the bahamas two days after my wife’s death, well that should be admissable, no?
His career is ruined. His reputation is ruined. He’s a narcissist and that is far worse of a punishment than any jail term.
I agree with most of what you are saying, except this one point:
Sending a tweet (using a hashtag to improve the odds of her reading it) saying that he is in the same place that she is, when he was not, is a pretty good place to start.
Not a problem - we all have bad days and we all have reasons to be angry. Heck, I can be as much a troll as the best of ‘em, so I’m sure there are times I deserve it. Either way, no harm, no foul. :)
