Agreed. Our law requires informed consent, but does not require a signed affidavit. It is a choice made between the doctor and patient, and one that is not documented anywhere (I mean, certainly the prescription is documented, but there is no requirement that an affidavit be saved to the patient’s file). Which I like.

Yeah. I don’t know how a City that is doing that poorly financially would even get bonds to cover that. I’m sure their bond rating is ridiculously low. That doesn’t excuse anything that has happened her, but people always get angry and think the government should pay huge amounts of money. And the government should.

It is. My guess is that the reason the lawyers actually got so much is because they wanted to make it hurt as much as possible. Since she was limited in what she could actually recover, the only way to hit the university hard was to recover high attorneys’ fees.

I’m not 100% convinced that he did rape her. But I am 100% convinced that the University did a horrible job handling it and violated her rights. So, I’m good with this settlement.

But that wasn’t the settlement. The maximum settlement she could have achieved under the law was $300k. She got close to that, $250k. The attorneys’ fees are an additional component of settlements, and are not considered part of the petitioners’ award.
