I think you're misinterpreting the placement of "again". He said he'd arrest him again. In order to arrest him again he would have had to arrest him a first time.

Key word in your OWN response : "again." They'd ARREST HIM AGAIN. As in they arrested him ONCE and would do it AGAIN.

They would arrest him again, if he would take electricity again. In order for him to be arrested again, he has to have been arrested at least once before.
