Judging by how the whole reason he fled was because of a "police involved shooting", I'd say that qualifies as a felony for the felony murder rule.

5th time I've said this. It isn't that clear cut! 1st degree murder doesn't have to be pre-meditated. The "felony murder" rule in California could potentially make this a 1st degree murder. Definitely 2nd degree. Up to the DA and what kind of deals they can get.
That simply isn't true. I'll explain this again. In California, we have a "felony Murder" rule. Since he was in commission of a dangerous felony, he will be charged with at least 2nd degree, and can be charged with 1st degree.

Unfortunately, that's not how it works. If it's not premeditated, it's not 1st degree murder. He'll face charges of either 2nd degree murder, or manslaughter, depending on how the plea bargaining turns out.
