Yep that Kickstarter started before this policy was put in place. The policy I've been speaking of started in November 2012 (I think), and only affects Kickstarters after that date.

Kickstarter forces the rewards in the reward tiers to be given, no matter what. So since they are guaranteeing the movie in the rewards, and if it isn't made, they are bound by the Kickstarter agreement to give the money back.
