By the time they got their oscars they were both extremely well-known actresses. Hell, Hathaway had already done two princess diaries and The Devil Wears Prada.

The real danger here is to emulation in general. The way the suit is is worded, if it goes to court and Nintendo wins, could have ramifications for emulation going forward and give Nintendo a legal precedent to go against older projects like Dolphin, SNES emulation, etc.
