Right, but the ruling was only “as applied.” So it would certainly be precedent someone could cite for a similar circumstance, but the basic anti-discrimination rule is still on the books and still enforceable.

No, she did not claim heritage for free tuition. She does have a Native ancestor and put it on a couple of bar documents, but never used it to get ahead academically or professionally. More likely her employer used it to claim diversity, which is admittedly pretty shitty. 

IIRC, Warren only claimed descent as part of family lore and did not use it to gain any sort of advantage academically or financially. Harvard listed her as Native to bolster its diversity credentials. But do verify that.

This is Jezebel. Sometimes it’s totally proper to mock someone’s personal appearance, lifestyle choices, relationships, and mental or physical health.
