I wouldn't even say it's about damages at this point, it's about 'hey, we own something and you're trying to make money off of it'… like Axanar Coffee or asking for donations directly from their website which isn't in their official budgets.

Take a look at what they were doing in the background, they were trying to set up a for profit studio with the money, and they were selling 'Axanar Coffee' to make further money for the producers.
