No, it isn’t. Diesel emissions are regulated, and have been for some time, under the Clean Air Act. A provision in that act make it illegal to tamper with or remove the emissions control equipment—which includes particulate filters, SCR systems, and the engine computer, among other things.

Historically, private lawsuits, especially the group / class action kind force government agencies to take a closer look at activities that are harmful / dangerous so that proper laws can be drafted to curtail such asshattery.
