You must have missed the part that could include FEDERAL wiretapping laws not just state laws...I mean I know, I know that would have actually required reading the ENTIRE article and not just the first couple of sentences....
Actual lawyer who knows something about the law in question: the consent of one party to the conversation is an exception to the federal wiretap act, and it does not apply. The California law wiretap law arguably does apply, as others have noted, because California requires the consent of all parties.
