it’s a civil case tho. I’d feel different if it was a criminal case, but I got no problem with this reasoning in a civil case.

I just hope you spend the same amount of time and coverage presenting some of the inconsistent testimony and evidence from the plaintiff in this matter. Specifically the text messages that were sent by the plaintiff to Rose the day after the alleged rape. Which included her calling him “babe” in multiple instances.…

Yeah, it’s a civil case so money is the only issue. I could just as easily call her a money grubbing slut as you called him a rapist. Goes both ways.

How many times have you been doing something while drunk, that you are totally aware of, but the next day it’s just bits and pieces? It’s entirely possible for Rose to have not known she was far drunker than she appeared, or was acting.

You are 100% right that someone who is wasted or passed out cannot give consent... except that Rose is arguing that she was awake, aware, and sober the entire time. You can think he is lying, but the story he told is one of consent - for anyone other than those who do want the signed contracts.

This site has done a great job profiling the problem in society with victim-shaming etc and that certain institutions and psychological dynamics make it difficult for victims (read: women) to come forward in situations of sexual and assault and rape. That said, the coverage of this case on Deadspin has made it seem…
