While I see what you mean in this case it does NOT beg the question "would he honor one no over the other". He admitted to honoring one over the other. She said no to sex, he kept going and that is rape.

And you have video/audio proof as well as three nuns who can testify on your behalf.

According to the judge because he listened when she said no to anal and oral he *clearly* had no intent of rape...even though she said no to sex in general. But the rapist didnt think she meant "NO" for vaginal sex. The rapist clearly understood that no meant no for oral and anal. Therefore no rape. Because...logic.
