A lot of the games offered on the classic consoles are Nintendo made titles, so the money does go to the company that made the games.

The legality of downloading roms is questionable. Although I don’t have an issue with downloading most roms, downloading games that are actively being marketed, either via virtual console or official hardware, is piracy.
