I think that because the photos are taken for a commercial purpose (yearbooks aren't free) that the essential contract of free modeling for yearbook representation is broken if the photo is not representational. Clearly the students who modeled for these pictures do not believe they are representational.

Depends on the contract. Some photographers sell the rights to the photos — and it's become a sticking point for things like wedding and graduation photos that people want to be able to reproduce. Especially these days when formats change fast.
