If you want to be technical here, I so far have not seen a single example where she has actually used any of the freelancer's photos for her promotional use. She has not committed any "crime" as of yet, but there is a huge uproar against it.

1. I am not making it up. The photographer states in his edit to his blog post that he was not hired by Taylor. He was hired by a publication:

I don't see the issue. Taylor is not using the photographs for commercial purposes, meaning she is not selling these photos. Taylor's business and profits have nothing to do with using the photographer's work, so this has no parallel to the Apple case.
