Adb backup was added to the 4.0 API. There's nothing a dev can actually do about that. There are plenty of root options for below 4.0.

Unlikely? It is actually expected. Google never deletes anything. Anything. Ever. They maybe would disable that as a feature eventually, but the files will almost definitely exist on their servers until the end of digital data.
