Kevin, the theaters have cover though and they aren't likely to lose any suit even if something happened. Homeland Security has deemed the "threat" not credible, and they should know. They aren't taking it seriously so neither should the theaters.
I've got an iPhone Edge (7 years now) and a 3G (6 years old) and batteries are still going strong. Just because you haven't seen something doesn't mean it doesn't exist. I also have a 2004 iPod, now 10 years old, that has a good battery.
