If the president was killed in a movie would it be illegal, no, its fictional. The costume is fictional thats sort of the point of a costume.

However this doesnt justify the costume.

I dont think it was intended to be racist. I think they want the president in jail and executed from what I gathered from the costume. In essence they want the president dead but most likely not because he is black but because most people feel that he did a poor job.
