American citizens who are pointing guns at you and will gladly kill you, because they do not WANT to go to trial. Dont get me wrong, if cops walk into a place and start killing left and right sure thats bad, but like the video shows, all the criminals in the game have a chance to put their hands up and get arrested.

The word you're looking for is "real". Unless you've been in war, it'll be easier to justify. But everyone usually has had a run in with the cops, no matter how minor. Its too close to home.

Just as GTA plays into the power fantasy of breaking all the laws set in your society as a power fantasy catharsis for regular people? Or any military shooter plays into the power fantasy of killing someone you've been told not to like?

If you take it like that then any game where you kill someone in a semi realistic setting is "the problem". The only things I can think of off the top of my head that would be acceptable is Titanfall and Advanced Warfare.

I actually mention that in another post, but in those games its not inherently "real", in those games you are taking on high level crime, in BFHL you kick down a door that could easily be your or your neighbors door. If anything I'd say this game is actually better than the other battlefields as you score MORE points for the nonlethal way, while the others "teach" people that soldiers one job is to go kill as many people in a foreign land as possible and get off scott free.
