It also matters whether the NDA is with Harvey or with the Weinstein Company. The company has much stronger incentives now not to try to enforce the NDA against a rape victim, as they would like to keep doing business.

Weinstein could sue for breach of contract. But unless he won on summary judgment, there’d be discovery, which would mean McGowan’s lawyers would get to grill Weinstein under oath about whether he raped her. Weinstein probably does not want to do that, so he’d be better off not doing that.

Oh, I can definitely imagine myself being corrupted into being a murderer, or non-corruptly killing in self-defense.
