I’ve figured for a couple weeks now that his only way out of this is to try and do it by executive order, which will be challenged in court, and has a pretty strong chance of being shot down. And with the pace of federal courts and appeals etc, we probably wouldn’t get a result for a year and a half…

Trump is probably weighing whether or not to try and do it via executive order, because the timing would most likely put its legal challenges up for a final determination right around election time in 2020. And he probably knows he’d lose, and of course, he doesn’t want to look like a loser before the election.
