Most of the time O2 CELs are disabled by putting the front O2 sensor in a constant state of "not ready" that would cause a car to fail in a state like mine (IL) that requires all emissions equipment to display readiness when scanned from the OBDII port.

In IL, in the counties that smog, a CEL is also an automatic fail. Actually, if your readiness codes have been reset, it's also a fail.

Apparently, it's legal gray area. If it's disclosed, then no problem for the seller. Some states, however, allow a buyer to cancel a sale if the car cannot be legally registered due to not possessing all required emissions equipment.

I did this all the time when I sold cars. Dealerships are all closed on Sundays in IL. I’d flip a customer a set of keys Saturday afternoon and tell them to come see me before 9PM Monday.
