I’d guess that the including the owner’s estate in the suit was a CYA move by the lawyers and depending on circumstances that estate may be dismissed from the case. If you don’t include them, it would leave enough wiggle room in the case for the driver to escape liability through some tricky legal framing/maneuvers.
