That’s not what the law is. The difference between a contractor and an employee is the amount of control the principal (here, Uber) has over them.

Those aren’t the only differences between contractor and employee. Who controls availability for work, location of work, and work schedule are big. As are (I believe) requirements/restrictions on types of tools/equipment (i.e., you can’t drive for Uber if you have a ‘77 Vega).
